MealArt Terms of Use

1. What these terms are about
These terms are an agreement between you and Artem Tatarchenko, a private individual in Switzerland who runs MealArt ("we" or "us"), about using the MealArt app at mealart.app.
You accept these terms when you tap "Get code" to sign in. If you use MealArt without an account, these terms still apply. This is especially true of section 4, "Not medical advice".
How we handle your data is explained in our Privacy Policy. The policy is information, not a request for consent: accepting these terms does not mean you consent to any data processing. We ask for your consent to store health data separately.
2. Who can use MealArt
- You must be at least 16 years old to create an account.
- One account is for one person. Don't create an account with someone else's email address without the owner's permission.
3. What MealArt is
MealArt helps you keep a food diary, count calories and macros (protein, fat, carbs), work out a guideline daily target, log your cooking and recipes, and keep a shopping list. Without an account, your data is stored only on your device. With an account, it syncs between your devices.
Pictures in the catalog are illustrations and may not look like your dish. Nutrition values for foods and dishes are averages taken from public sources and food labels.
4. Not medical advice
- MealArt's targets, calculations and tips are guidelines based on generally accepted formulas and average values. They are not a diagnosis or treatment, and they don't replace a doctor or dietitian.
- The numbers are approximate. What's in a food varies between brands and batches. The calculation for a cooked dish depends on how accurately the ingredients were weighed.
- Label reading and barcode data can be wrong. Text recognition makes mistakes, and product data from other MealArt users and from Open Food Facts is entered by people. Data can be wrong even when it is marked as confirmed. Check the numbers against the package before saving.
- Allergen markers can be wrong. Manufacturers change their recipes. If you have an allergy, always read the ingredients on the package.
- Talk to a doctor before changing your diet if you are pregnant or breastfeeding; have diabetes, kidney disease, heart disease or another chronic illness; take medication, especially for weight loss or diabetes; or have, or have had, an eating disorder.
- If counting your food causes anxiety or obsessive thoughts, stop counting and talk to a professional.
- If you feel unwell, call 112 or your local emergency number.
5. Your account
- You sign in with a code we send to your email. There are no passwords. This means your account is only as secure as your email.
- Never share the code from the email with anyone. If someone other than you has signed in to your account, write to us.
- Your email address must be your own and active: without it, you can't sign in.
6. Your entries
- Everything you enter in MealArt belongs to you. You give us the right to store and sync these entries and show them to you, for as long as this is needed to run the service. Products with a barcode are the one exception, see "Shared product database" below.
- We don't use your entries for advertising, and we don't sell them.
- We are a small, free project and we don't make backups at the moment. Please save a copy from time to time: Profile → Account → "Save a copy".
Shared product database. When you save a product with a barcode while signed in, its name, brand, nutrition values and serving size go into the shared MealArt product database, where other users can see them without your name (see the Privacy Policy, section 12).
- By saving such a product, you give us a free, worldwide, non-exclusive and permanent permission to store, check, correct, combine and show this product data to all MealArt users.
- If you delete the product or its barcode while you have an account, we remove your entry. If you delete your account, your entries stay in the database without any link to you, and this permission continues.
- Enter only what is printed on the package. Don't put personal information, or anything you have no right to share, into the product name.
- We don't guarantee that product data from other users is accurate. We may correct or remove entries that look wrong, are spam or break these terms.
7. What you must not do
- Don't try to access other people's accounts or data.
- Don't get around security measures, break or overload the service, or send automated bulk requests.
- Don't copy the catalog or the food database by automated means.
- Don't enter false product data or spam on purpose.
- Don't use MealArt for illegal purposes.
- Don't reverse-engineer the app's code, except where the law expressly allows it.
8. Rights in MealArt
The app, its design, texts, code, name and logo belong to us or our licensors. You may use MealArt for personal, non-commercial purposes. Third-party components (the font and libraries) are distributed under their own licenses. You'll find the list on the Licenses page.
9. Free service, changes and shutdown
- MealArt is free right now. If we introduce paid features, we'll tell you in advance, and we won't charge you anything without your separate consent.
- We may add, change and remove features.
- If we decide to shut down MealArt, we'll give you at least 30 days' notice, so you have time to download your data.
- We may delete an account that nobody has signed in to for 24 months. We'll warn you by email 30 days before we do.
10. Liability
- MealArt is free and provided "as is". We try to keep it running without problems, but we can't guarantee that.
- We are fully liable for intent and gross negligence, for injury to life, body or health caused by our fault, and in all cases where liability cannot be limited by law.
- In all other cases, because the service is free, we are not liable for the consequences of slight negligence, including loss of data, to the extent permitted by applicable law.
- Nothing in these terms limits the rights you have under mandatory consumer protection law.
11. Deleting your account and blocking
- You can delete your account at any time: Profile → Account → "Delete account". All your entries and your email address are erased from the server immediately. Your diary stays on this device.
- We may block or delete your account for a serious or repeated breach of section 7. Where possible, we'll warn you first and let you download your data.
12. Changes to these terms
MealArt is new and changes often, so different kinds of changes work differently:
- New features. A new feature may come with its own rules. They apply from the moment you start using that feature, and we'll show them to you then. They don't change anything for the features you already use.
- Changes that are required by law or by an authority, that fix security problems, or that only benefit you apply right away.
- Other significant changes that affect features you already use: we'll tell you in the app or by email at least 30 days before they take effect. If you don't agree, you can delete your account before that date. If you keep using MealArt after that date, the new terms will apply.
- Minor edits that don't change your rights, such as fixing typos, are made without notice.

13. Governing law and disputes
- These terms are governed by Swiss law, to the extent the law allows. If you are a consumer and live in another country, the mandatory consumer protection laws of your country still apply to you.
- You can take legal action in the courts where you live.
- But first, please write to us: most issues are resolved faster by email.
- We are neither obliged nor willing to take part in out-of-court dispute resolution proceedings with consumers.
14. Languages
These terms are written in English. If we publish translations, the English version prevails, unless the law requires otherwise.
